Winfred Fernandis, Jr. just got the stitches removed from his lip where police say his neighbor, Daniel Allen, bit him -- bit right through his lip -- during a scuffle Sunday in their Clinton Township neighborhood. "He didn't throw one punch at me," said Fernandis. "He grabbed up, and the first thing he did was bit me and scratched me and it seemed like he was aiming towards something." But Fernandis' wounds may be much deeper and not as apparent. His neighbor and alleged attacker admitted to FOX 2 he is HIV positive. FOX 2's Bill Gallagher asked Allen, "Are you HIV positive?" He responded, "Yes, I am." Taryn Asher asked Fernandis, "Did you know that he is HIV positive?" He replied, "No. I did not." Fernandis fights back the tears as he thinks about the implications. Fernandis, who was immediately put on antiretroviral drugs as a precaution, appears to be the victim. But Allen tells a different story, claiming this was a case of self defense. What appears to have been a fight over a football that was tossed into Allen's lawn erupted into violence because, he says, he's gay. "The hostility towards me is because it's a hate crime because of my sexuality," said Allen. "That could not possibly be. I am a cosmetologist. I deal with gays all the time," Fernandis said. "It's definitely not (a) hate crime because I got love for everybody. I mean, definitely God is in my heart." Even though police say Allen is the one who attacked Fernandis and he's been charged with aggravated assault, Allen keeps pictures of his own injuries and has since filed a personal protection order against Fernandis. As for Fernandis, "It's just so much going through my mind right now." All he can do is wait. He gets tested for HIV on Thursday. "I'm just praying right now, really praying," said Fernandis. Doctors will not be able to tell Fernandis whether he has HIV for another few months.
